Current wording of Section 19A[edit | edit source]

19A Maintenance of home education register

(1) A local authority in England shall maintain a register for the purpose of monitoring the provision of education to children of compulsory school age in their area who are not educated at a school or under section 19.

(2) Regulations may make provision about maintenance of the register.

(3) The regulations may, in particular, make provision about amendment of the register.

(4) In this Act—

“home-educated child” means a child all of whose education is provided otherwise than at a school, and not under section 19;

“home education register” means a register maintained under this section.

Series A of amendments[edit | edit source]

This is a set of amendments which aim to make the maintenance of a home education register the responsibility of local authorities, and not of parents.

Amendment A1

Section 19A(2) after "about" insert "local authority"

Amendment A2

Section 19A(3) after "about" replace with "local authority responsibilities to amend the register"

Series B of amendments[edit | edit source]

This is an amendment which changes the purpose of maintaining a home education register, from monitoring to the provision of services.

Amendment B1

Section 19A(1) delete "for the purpose of monitoring the provision of education to" and replace with "for the purpose of providing services to"

(2) Regulations may make provision about local authority maintenance of the register.

(3) The regulations may, in particular, make provision about local authority responsibilities to amend the register.

(4) In this Act—

“home-educated child” means a child all of whose education is provided otherwise than at a school, and not under section 19;

“home education register” means a register maintained under this section.

Why "shall maintain"? Why not "may maintain"?
